End User License Agreement (EULA)

This End User License Agreement ("Agreement") is between you and Bismah Farooq (the "Licensor") and governs your use of the Licensor's mobile applications (each a "Licensed Application") on Apple-branded products. This Agreement incorporates Apple's minimum terms for Licensed Applications. Apple is not a party to this Agreement and has no responsibility for any Licensed Application or its content.

1. Acknowledgement

You and the Licensor acknowledge that this Agreement is concluded between you and the Licensor only, and not with Apple. The Licensor, not Apple, is solely responsible for the Licensed Application and its content. This Agreement may not provide usage rules that conflict with the Apple Media Services Terms and Conditions.

2. Scope of License

The Licensor grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the Licensed Application, and you may not copy (except as permitted by this license), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application.

3. Consent to Use of Data

You agree that the Licensor may collect and use technical data and related information to facilitate the provision of software updates, product support, and other services related to the Licensed Application. The Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies. Collection and use of personal data is governed by our Privacy Policy.

4. Subscriptions

Licensed Applications may offer optional auto-renewing subscriptions billed through your Apple ID. Subscription terms, renewal, and cancellation are described in our Terms of Service and managed through your App Store account settings.

5. Maintenance and Support

The Licensor is solely responsible for providing any maintenance and support services for the Licensed Application. You and the Licensor acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for the Licensed Application. For support, contact bismahfarooq58@gmail.com.

6. Warranty

The Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Licensor's sole responsibility.

7. Product Claims

You and the Licensor acknowledge that the Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property Rights

You and the Licensor acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement).

12. Third-Party Beneficiary

You and the Licensor acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

13. Termination

This Agreement is effective until terminated by you or the Licensor. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you shall cease all use of the Licensed Application and destroy all copies of it.

14. Governing Law

This Agreement is governed by the laws of the jurisdiction in which the Licensor resides, subject to any mandatory consumer protections of your country of residence.
